1. Acceptance of Terms

By accessing or using Drifolio, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Platform Description

Drifolio is a vehicle profile and ownership documentation platform. Drifolio allows users to create vehicle profiles, store ownership-related information, upload vehicle photos and private vault documents, manage service and ownership records, set optional maintenance reminder targets, receive dashboard, push, and email reminders where available, use private sharing features, manage notification center preferences, view recall campaign records where available, use vehicle transfer tools, track ownership history, participate in referral or trial promotions, install Drifolio as a web app, and optionally publish public vehicle profiles or sale-related listing information.

3. User Accounts

• You are responsible for your account credentials and for keeping your login information secure.
• You must provide accurate, current, and complete account information.
• You are responsible for all activity that occurs under your account.
• You may not use another person’s account without permission.
• You must notify Drifolio if you believe your account has been accessed without authorization.

4. User Content

You retain ownership of content you upload or submit to Drifolio, including vehicle photos, vehicle records, notes, documents, descriptions, and sale-related information. By submitting content, you grant Drifolio a non-exclusive, worldwide, royalty-free license to host, store, display, process, transmit, reproduce, and distribute that content solely as needed to operate, provide, improve, secure, and promote the platform.

• You must own or have permission to upload all content you submit.
• You may not upload copyrighted material, logos, trademarks, private documents, or third-party content without authorization.
• You may not upload misleading, fraudulent, offensive, unlawful, or harmful content.
• You are responsible for reviewing public profile content before publishing or sharing it.

Drifolio may use automated tools, including AI-assisted tools, to help generate, format, summarize, optimize, or display platform content. AI-assisted content may be incomplete, inaccurate, or unsuitable for decision-making. You should review any AI-assisted content before relying on it or publishing it.

Maintenance reminders, Next Due dates, mileage targets, dashboard alerts, notification center messages, push notifications, and email notices are convenience features only. They may be based on user-entered data, default intervals, or incomplete records. You remain responsible for inspecting, maintaining, repairing, and safely operating your vehicle according to manufacturer guidance and professional advice.

5. Vehicle Data Accuracy and No Reliance

Drifolio does not independently verify mileage, service history, ownership claims, modifications, receipts, photos, VIN accuracy, title status, sale information, accident history, lien status, or any other user-submitted data. All vehicle information is provided by users and may be incomplete or inaccurate.

You agree not to rely solely on information provided through Drifolio when purchasing, selling, financing, insuring, valuing, inspecting, repairing, or evaluating a vehicle. Users, buyers, sellers, dealerships, insurers, lenders, and other third parties should conduct their own independent due diligence.

6. Recall Campaign Records and Third-Party Safety Data

Drifolio may display recall campaign records, safety campaign information, or related vehicle safety information from public sources such as the National Highway Traffic Safety Administration (NHTSA) or other third-party data providers. Recall campaign records shown in Drifolio are provided for convenience and review only.

Recall campaign records may be based on year, make, model, trim, VIN, or other vehicle information and may not confirm that a specific vehicle has an unrepaired recall. A campaign record appearing in Drifolio does not mean the recall applies to your exact VIN, remains open, has not been repaired, or requires immediate service. A campaign record that does not appear in Drifolio does not mean your vehicle has no recall or safety issue.

Users should verify VIN-specific unrepaired recall status through official sources, including NHTSA's VIN lookup tool, the vehicle manufacturer, or an authorized dealer. Drifolio is not affiliated with, sponsored by, or endorsed by NHTSA or any vehicle manufacturer unless expressly stated.

Recall notifications, recall campaign counts, completion tracking, dismissed campaign status, and related dashboard messages are convenience and organization tools only. You remain responsible for reviewing official recall notices, following manufacturer instructions, contacting qualified dealers or repair professionals, and safely operating and maintaining your vehicle.

7. Public Profiles and Private Sharing

If you enable public visibility, selected vehicle information, records, photos, sale details, and profile content may be viewable by the public. If you use private sharing features, the people who receive your share link may be able to view the information made available through that link until it expires or is revoked.

You are responsible for deciding what information to publish or share and for removing or redacting sensitive information before making any vehicle profile public or sharing it with others.

8. Vehicle Transactions

Drifolio is a software platform only. Drifolio is not a vehicle dealer, broker, escrow provider, payment processor, financing provider, insurer, inspection service, appraisal service, title service, or party to any vehicle transaction.

Any vehicle purchase, sale, inspection, negotiation, payment, financing, delivery, title transfer, registration, warranty claim, or related transaction is solely between the involved parties. Drifolio does not guarantee vehicle condition, value, ownership, title status, lien status, payment completion, buyer or seller identity, or transaction outcomes.

Drifolio is not responsible for fraud, misrepresentation, failed payments, disputes, inspections, repairs, delivery issues, title issues, or losses arising from vehicle transactions or communications between users and third parties.

Vehicle transfer tools, where available, are software features that may help users invite another person to accept a vehicle profile into their Drifolio account and preserve ownership history inside Drifolio. Drifolio does not verify legal ownership, title status, liens, registration status, payment completion, vehicle condition, buyer identity, seller identity, recipient identity, or legal transfer compliance.

Users are solely responsible for completing all required legal, financial, title, registration, inspection, insurance, tax, DMV, and ownership transfer requirements outside of Drifolio. A completed Drifolio vehicle transfer does not by itself transfer legal title or satisfy government registration requirements.

9. Paid Memberships and Billing

Certain Drifolio features may require a paid subscription or membership plan. Billing is processed by third-party payment providers, such as Stripe. By purchasing a paid plan, you authorize applicable charges according to the plan, price, and billing cycle shown at checkout.

Subscriptions may renew automatically until canceled. You are responsible for managing or canceling your subscription before renewal. Fees are non-refundable except where required by law or expressly stated otherwise by Drifolio.

Feature access, vehicle limits, photo limits, document limits, private vault access, private sharing, sale-listing capabilities, vehicle transfer features, ownership history tools, dashboard reminders, notification center features, push notifications, email maintenance reminders, notification device limits, and other platform features may vary by plan. If your plan is downgraded, canceled, unpaid, inactive, expired, or reverted after a trial, access to paid features may be reduced, paused, restricted, hidden, read-only, or unavailable. Vehicles, records, photos, documents, or private vault items above the current plan limit may remain stored but hidden or inaccessible until an eligible plan is restored. Free accounts may see dashboard maintenance reminders and limited push reminders when supported by the user’s device and browser, while automated email reminders may be limited to Premium and Pro accounts. Push notification limits, supported categories, and device limits may vary by plan. Drifolio may change membership fees, plans, or included features over time, but changes will not affect an active billing period unless otherwise disclosed.

Drifolio may offer promotional memberships, referral rewards, vehicle-transfer incentives, free trials, or limited-time access to paid features. Eligibility requirements may vary and may be denied, revoked, shortened, or modified if Drifolio detects fraud, abuse, duplicate claims, payment issues, or misuse. Promotional access does not create a permanent entitlement to paid features.

If you request account deletion while you have an active paid subscription, your subscription will be set to cancel at the end of the current billing period. Your account and data will be scheduled for deletion at that time. No prorated refunds are issued unless required by law.

10. Prohibited Use

• No impersonation, fraud, deceptive listings, or misleading vehicle claims.
• No scraping, bots, abuse, probing, unauthorized access, or attacks.
• No malware, harmful uploads, viruses, or attempts to disrupt the platform.
• No offensive, hateful, exploitative, infringing, or illegal material.
• No unrelated spam, fake listings, deceptive promotions, or abusive automation.
• No use of Drifolio to violate another person’s privacy, intellectual property, or legal rights.
• No attempts to bypass plan limits, trial eligibility rules, referral rules, security controls, access controls, or visibility settings.

11. Right to Remove Content or Restrict Access

Drifolio may remove content, restrict access, downgrade visibility, suspend accounts, terminate access, or limit platform features at its sole discretion to protect users, the platform, third parties, legal compliance, security, or platform integrity.

12. Privacy

Your use of Drifolio is also governed by our Privacy Policy. Please review it to understand how information is collected, used, stored, and shared.

13. Notifications, Email Reminders, and Service Communications

Drifolio may send service-related communications, including account notices, verification messages, subscription and membership notices, transfer notices, referral notices, data deletion notices, dashboard reminders, notification center messages, push notifications, and maintenance reminder emails for eligible plans.

Push notifications require browser or device permission and may require installing Drifolio to the device home screen. Notifications may be delayed, blocked, disabled, duplicated, or unavailable because of browser settings, operating system settings, device battery settings, network conditions, expired subscriptions, expired push endpoints, third-party service outages, or service provider limitations.

Dashboard reminders, notification center messages, push notifications, transfer notices, membership notices, and email reminders are not guaranteed to be delivered and should not be used as the only source for safety-critical maintenance decisions. You remain responsible for inspecting, maintaining, repairing, and safely operating your vehicle.

14. Service Availability and Data Loss

Drifolio is provided on an “as is” and “as available” basis. Drifolio does not guarantee uninterrupted service, error-free operation, continued feature availability, permanent data retention, or that all content will remain available at all times.

You are responsible for keeping independent copies of important vehicle records, documents, receipts, images, and other information. Drifolio is not responsible for loss of data, service interruptions, downtime, or unavailable content except where required by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Drifolio and its owners, affiliates, service providers, and representatives from any claims, damages, liabilities, losses, costs, or expenses arising from your use of the platform, your content, your vehicle transactions, your violation of these Terms, or your violation of any law or third-party rights.

16. No Warranty

The platform is provided without warranties of any kind, whether express, implied, statutory, or otherwise. Drifolio disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability to the fullest extent permitted by law.

17. Limitation of Liability

To the fullest extent permitted by law, Drifolio shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, lost business, vehicle transaction losses, loss of goodwill, or other damages arising from platform use.

18. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Texas is used as the governing law because Drifolio operates from the United States and is based in Texas.

19. Changes to These Terms

We may update these Terms periodically. If we make material changes, we may provide notice through the platform or by other reasonable means. Continued use of Drifolio after changes are posted means you accept the revised Terms.
